What does a solicitor do?

When you’re purchasing a property with a mortgage, the solicitor has a dual role:

(1) He/she will protect your interest and ensure that the property you purchase is fully compliant and has a good clean title and
(2) To certify the title to the lender so that the mortgage monies can be drawn down from the lender.

Purchasing a house is a complicated process. A solicitor can help you ensure that what you purchase is yours, has all the services needed and no restrictions on what you can and cannot do with the property. The lender will also insist on a solicitor being involved to process the mortgage, stamp the purchase deed with the Revenue Commissioners and register the transfer with the Property Registration Authority.

Your solicitor is your advisor, so the earlier you engage a solicitor, the better. You will need your solicitor’s details when you pay a booking deposit to the auctioneer and that is when the solicitors work really begins.

You have three milestones where you need to budget your payments:

1) Booking deposit – This is paid to the auctioneer and is a wholly refundable deposit until you sign contracts.

2) Balance contract deposit – This payment is made to your solicitor who then transfers it to the vendor’s solicitor and will bring your total payments (to include the booking deposit) to 10% of the total price of your property.

3) Completion – Immediately prior to completing the purchase, you will be required to transfer the balance monies, legal costs and outlays due to complete the purchase of the property to the solicitor. Your solicitor will issue a completion statement to you when they apply to the bank for the mortgage monies that set out in detail all of the costs involved. Once the mortgage monies are received from the bank, then your solicitor will transfer the balance of the purchase monies to the vendor’s solicitor and complete the transaction.

When you are purchasing a property with a mortgage, all of the title deeds are sent to the lender once you are registered as the owner with the Property Registration Authority.

A copy of the government register folio confirming you as owner will be sent to you when the originals are all sent to the bank. Then with your authorisation, we can hold a copy of your deeds digitally, so that if you decide to switch mortgages or sell in the future, you will have immediate access to your deeds.

Once you’re onboarded with Beam, we manage all aspects of the transaction. We will then notify you of any steps that need to be taken and you can follow the progress of your conveyancing via our client portal.

Begin by contacting your conveyancing solicitor and applying for the title deeds from your existing mortgage bank.

Updating Land Registry records when changing lenders is a legal necessity, and incurs a new fee separate from the initial purchase fee. When you switch mortgages, your new mortgage is registered against the title deeds, this fee is charged for updating your record. The fees are outlined here Land Registry Fees – Tailte Éireann.

However, we acknowledge that unforeseen delays can occur. Accessibility to your deeds or waiting for essential documents from the vendor’s solicitor might extend the process beyond our preferred timeframe.

Rest assured, we are committed to efficiency. Within 24 hours of your initial meeting with your solicitor, we promise to onboard you and request your sales advice notice. Subsequently, within the same timeframe, we formally request your contract and title documents from the vendor’s solicitor. Our commitment extends to reviewing these documents within 48 hours of receiving them, and promptly addressing any pre-contract queries that arise during this period.

We welcome recent utility bills such as ESB or phone bills, along with bank statements or government letters displaying your PPS number. It’s important to note that the document should be dated within the last 3 months. Furthermore, ensure that the name on your proof of address aligns with the name on the ID document you’re submitting. In cases where names differ, additional documentation, like your marriage certificate, may be required for submission.
